Terms of Service

These are the rules for using Atlas Gourmand. We have tried to write them in ordinary English, and each section has a short plain-language summary. The summaries are there to help you read faster — the full text is what governs.

1. Who you are agreeing with

Atlas Gourmand is operated by an individual sole proprietor based in New York (“we”, “us”). You can reach us any time at elise@atlasgourmand.com.

By using the site or creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Atlas Gourmand.

2. Who can use Atlas Gourmand

You must be at least 13 years old to create an account.

Some countries set a higher minimum age for consenting to online services on your own — in parts of the European Economic Area it is 14, 15 or 16. If you live somewhere with a higher age and you are under it, you may only use Atlas Gourmand with the consent of a parent or guardian, who agrees to these Terms on your behalf.

In plain terms13 and up. If your country says you have to be older than 13 to sign up for things yourself, you need a parent’s say-so until you reach that age.

3. Your account

Atlas Gourmand has no passwords. You sign in either with a six-digit code sent to your email address, or with your Google account. Keep control of whichever one you use — anyone with access to your email or your Google account can get into your Atlas Gourmand account.

If you sign up by email and later sign in with Google using that same address, you get the same account, not a second one. That also works in the other direction.

You are responsible for what happens under your account. Tell us at elise@atlasgourmand.com if you think someone else is using it.

4. What Atlas Gourmand actually is

Atlas Gourmand collects restaurant lists published by critics and other writers — Michelin, The New York Times, Eater, Time Out, The Infatuation, Condé Nast Traveller, The World’s 50 Best and others — and shows you which restaurants appear across several of them, on a map.

We do not own, operate, represent or endorse any restaurant on the map, and we are not affiliated with any of the publications whose lists we index. Their names and marks belong to them, and appear here to identify whose list a restaurant is on. Being on Atlas Gourmand is not a recommendation by us.

In plain termsWe are a map of other people’s restaurant lists. We do not run the restaurants, and we are not the critics.

5. The information may be wrong or out of date

This one matters, so please read it properly.

Restaurant details — addresses, opening hours, cuisines, prices, whether a place is still open at all — come from published lists, from restaurants’ own websites, and in some cases from manual research. Restaurants close, move, change their hours and change their menus constantly, and critics quietly edit their lists in place. We re-check our sources periodically, but at any given moment some of what you see here will be out of date.

Always confirm with the restaurant before you travel, book or rely on anything you read here— especially opening hours and whether a restaurant is still trading.

Atlas Gourmand is offered on an “as is” basis. We do not promise the information is accurate, complete or current.

In plain termsDo not drive across town on our say-so. Check with the restaurant first — we get things wrong, and so do the lists we read.

6. Things will change

Atlas Gourmand is young and under active development. Features may change, break or disappear, and we may add, suspend or remove parts of the service at any time. We will try not to lose your saved restaurants, but you should not treat Atlas Gourmand as the only copy of anything you care about.

7. Your saved list and profile

What you save, like, and put in your profile — your display name, username and picture — stays yours. You give us permission to store and display it back to you so the service can work. We do not sell it, and we do not publish your saved restaurants to other users.

Do not upload anything unlawful, or a profile picture or username you do not have the right to use, or one that impersonates somebody else. We may remove content that breaks this rule.

8. Using the service fairly

Please do not:

  • scrape, bulk-download or systematically copy the map data, or use it to build a competing dataset;
  • hammer the site with automated traffic, or try to get around rate limits or other technical restrictions;
  • try to access accounts, data or parts of the system that are not yours — including the admin area;
  • probe for or exploit security holes (if you find one, please tell us — see below);
  • use Atlas Gourmand to break the law or to harass anybody.

If you find a security problem, email elise@atlasgourmand.com and give us a reasonable chance to fix it before telling anyone else. We will not pursue you for good-faith research that respects other people’s data and does not degrade the service.

9. Emails from us

Some emails are part of the service and you cannot opt out of them while you have an account: sign-in codes, and the occasional message about your account or an important change to these Terms.

Marketing email is entirely separate and entirely optional. We only send it if you explicitly ask us to, by ticking the box yourself — we will never treat signing up as permission to market to you. You can withdraw that permission at any time, from the unsubscribe link in any marketing email or by writing to us, and it does not affect your account.

In plain termsSign-in codes: unavoidable, they are how you log in. Marketing: only if you tick the box, and you can untick it whenever you like.

10. Third-party services and links

Atlas Gourmand links out to restaurants’ own sites, to booking services, to Google Maps and to social profiles, and it draws its map tiles from OpenFreeMap. Those services are not ours and have their own terms and privacy practices. We are not responsible for them.

11. Ending things

You can stop using Atlas Gourmand at any time, and you can ask us to delete your account and everything attached to it by emailing elise@atlasgourmand.com.

We may suspend or close an account that is breaking these Terms, or that is being used to damage the service or other people. Where it is reasonable to do so, we will tell you why first.

12. Our liability

Atlas Gourmand is free. To the fullest extent the law allows, we are not liable for indirect or consequential losses, or for lost profits, lost data, or a wasted journey to a restaurant that turned out to be closed, moved, fully booked or not to your taste.

Where we are liable, our total liability to you is capped at US$100. That figure reflects that you pay us nothing.

Nothing in these Terms limits liability that cannot legally be limited — including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep every right your local consumer law gives you, and nothing here takes those away. Consumers in the European Economic Area and the United Kingdom in particular keep all mandatory statutory rights, whatever section 13 says about which law applies.

In plain termsIf we mess up, there is a limit to what we owe you — but your basic consumer rights are untouched, because we are not allowed to sign those away and would not want to.

13. Which law applies

These Terms are governed by the laws of the State of New York, and disputes go to the state or federal courts in New York County, New York.

If you are a consumer living elsewhere, this does not deprive you of the protection of the mandatory laws of your own country, or of the right to bring a claim in your local courts where the law gives you that right.

14. Changes to these Terms

We may update these Terms. The date at the top always tells you which version is live. If a change materially affects your rights, we will give you reasonable notice — by email to the address on your account, or a notice in the app — before it takes effect. Carrying on using Atlas Gourmand after that means you accept the new version; if you would rather not, you can close your account.

15. Odds and ends

If any part of these Terms turns out to be unenforceable, the rest still stands. If we do not enforce something straight away, we have not given up the right to enforce it later. These Terms, together with the Privacy Policy, are the whole agreement between us about Atlas Gourmand.
